These Terms of Use and Sale (the “Terms”) govern your access to and use of websites, stores, content, forms, and services operated by Strategicbongo, LLC, doing business as Demosophy (“Demosophy,” “we,” “us,” or “our”), including Demosophy.com, KristinRaffaelle.com, pages relating to 89 Seconds, and other sites or initiatives that link to these Terms (collectively, the “Sites”). They also govern purchases made through the Sites.
By accessing a Site, submitting information, creating an account, or placing an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the Sites or place an order. Certain features may have additional terms; if those terms conflict with these Terms, the additional terms control for that feature.
You must be able to enter into a legally binding agreement in your jurisdiction to make a purchase. The Sites are intended for a general audience and are not directed to children under 13. You may check out as a guest when that option is available. If you create or use an account, you are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly of suspected unauthorized use.
Demosophy publishes essays, Field Notes, interviews, commentary, educational materials, and other content for general informational and educational purposes. Content is not legal, medical, financial, tax, investment, psychological, or other professional advice and should not be treated as a substitute for advice from a qualified professional who understands your circumstances. We do not guarantee that content is complete, current, error-free, or suitable for a particular purpose.
An order is an offer to purchase. We may accept, reject, limit, or cancel an order, including because of inventory limits, suspected fraud, pricing or description errors, shipping restrictions, or inability to fulfill. An automated order confirmation acknowledges receipt; it does not necessarily mean the order has been finally accepted. If we cancel after payment, we will return the amount charged for the canceled item or order.
Signed and limited-edition products may have constrained inventory. Cart placement does not reserve an item. Product images are illustrative; screen settings and production variations may affect appearance.
Prices are shown in the currency identified at checkout and may change before an order is placed. The price charged is the price displayed at checkout when you submit the order, together with applicable shipping, taxes, duties, and other disclosed charges. A printed cover price is a publisher’s suggested or territorial list price and may differ from the direct-sale price for a signed, limited, bundled, or shipping-inclusive edition.
Payments are processed by third-party payment providers, currently including Stripe. Your use of a payment method is subject to the provider’s terms. You authorize us and our providers to charge the selected method for the total shown at checkout. You are responsible for taxes, duties, customs charges, and similar governmental assessments unless checkout states that we will collect them.
Physical-product orders are governed by the Shipping, Cancellation, Return and Refund Policy, which is incorporated into these Terms. Current launch shipping is limited to eligible United States addresses. Processing and delivery estimates are not guarantees. Risk of loss and title pass as provided by applicable law; nothing in these Terms limits rights that cannot legally be waived.
You may request cancellation before fulfillment begins. Signed copies are final sale except when an order arrives damaged or defective, contains an incorrect item, or applicable law requires another remedy. Problems must be reported within seven days after delivery so that we can evaluate and resolve them promptly. Digital products are generally nonreturnable after access or download, subject to the limited exceptions in the Shipping, Cancellation, Return and Refund Policy and any nonwaivable legal rights.
When you purchase an ebook, EPUB, download, or other digital product, you receive a limited, nonexclusive, nontransferable, revocable license for your personal, noncommercial use, unless the product page expressly states otherwise. A purchase does not transfer copyright or ownership. You may download and use the product on devices you own or control, but you may not reproduce, distribute, resell, sublicense, publicly post, share access credentials or download links, remove rights notices, create unauthorized derivative works, or use the product to train an artificial-intelligence system without our written permission.
We may use reasonable technical and account controls to protect digital products. We will provide reasonable assistance if a valid purchaser cannot access a purchased file because of a technical failure attributable to us.
The Sites and their content—including text, graphics, photographs, video, audio, logos, design, compilations, and trademarks—are owned by or licensed to Demosophy and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, nonexclusive right to access the Sites for personal, noncommercial use. No other rights are granted by implication or otherwise. Demosophy, 89 Seconds, Kristin Raffaelle, and related names, logos, and marks may not be used without permission except as allowed by law.
If you send comments, questions, testimonials, reviews, images, or other materials, you represent that you have the right to do so and that the submission does not violate law or another person’s rights. You retain ownership of your submission. You grant us a worldwide, nonexclusive, royalty-free license to host, reproduce, display, and use it as reasonably necessary to operate the Sites, respond to you, and—only where you have clearly authorized public use—publish or promote it. We may moderate or remove submissions at our discretion.
The Sites rely on or link to third parties, which may include WordPress, SureCart, Stripe, hosting providers, analytics and advertising services, social platforms, email providers, and shipping carriers. Third-party services are governed by their own terms and privacy practices. We are not responsible for an independent third party’s content, availability, or acts, but this does not limit responsibilities we cannot lawfully disclaim.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITES, CONTENT, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, COMPLETE SECURITY, OR THAT CONTENT WILL PRODUCE A PARTICULAR RESULT. PRODUCT WARRANTIES, IF ANY, ARE LIMITED TO THOSE EXPRESSLY STATED ON THE PRODUCT PAGE OR REQUIRED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEMOSOPHY AND ITS OWNERS, OFFICERS, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR OPPORTUNITIES, ARISING FROM THE SITES OR THESE TERMS. OUR AGGREGATE LIABILITY FOR A CLAIM RELATING TO A PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM; FOR OTHER CLAIMS, IT WILL NOT EXCEED USD $100. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Demosophy and its owners, officers, contractors, and agents from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Sites, your material breach of these Terms, or your infringement of another person’s rights. This section does not require indemnification for our own unlawful conduct.
We may suspend or terminate access when reasonably necessary to protect the Sites, users, or our legal rights, or when you materially violate these Terms. Provisions that by their nature should survive—including payment obligations, intellectual property, disclaimers, liability limits, dispute terms, and licenses already granted—will survive.
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Before filing a claim, you and Demosophy agree to make a good-faith effort to resolve the dispute informally by written notice and at least 30 days for response. Subject to any nonwaivable right to bring a claim elsewhere, the state and federal courts located in Maricopa County, Arizona will have exclusive jurisdiction, and each party consents to venue there.
We may update these Terms by posting a revised version and changing the effective date. Material changes apply prospectively unless law permits otherwise. If any provision is unenforceable, it will be modified only as necessary and the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, sale, or transfer of the business. These Terms and incorporated policies are the entire agreement concerning their subject matter.
